CONDITIONS OF WORK
Payment. Payment terms are to be agreed prior to the start of work. Advance payment may be required subject to the nature of the work.
Completion date. Liability for delivery on any stated completion date is limited to those processes in supply that are reasonably within the control of Cumberland Source Ltd. The customer accepts that unforeseen delays in the provision of materials and logistics may occur, or that changes to the final supply (for example make, model, quantity etc.) of antique items may be required. This should be taken into account especially where there are lead times of less than four weeks.
Warranty. Newly manufactured goods are made to a high standard using high quality materials. The customer accepts that some goods are not CE marked or structurally tested and therefore no liability is held by Cumberland Source Ltd for the safety or the structural integrity of these products. Old and antique items are sold in ‘as seen’ condition unless otherwise stated and the customer accepts that such items are inherently second-hand in nature and may carry visible, known or unknown vulnerabilities or defects. Cumberland Source Ltd accepts no liability for damages or loss of earnings arising from the customer’s use of second-hand items. The customer is solely responsible for installation and any costs complying with all requirements of the health and safety executive regarding the use or operation of all items supplied. Where there is any uncertainty please seek appropriate advice from a professional as part of your scope of work. No guarantees are given or implied unless otherwise stated.
Limitation of liability. Cumberland Source Ltd is liable for the delivery of the specified product to the agreed schedule and budget. All liabilities on goods supplied shall pass to the customer on delivery and/or collection regardless of payment in full or part thereof. If the customer is reliant on the above product or services as part of a wider scope or work or business schedule, Cumberland Source Ltd accepts no liability whatsoever for damages or loss of earnings which may be attributed to this product and its timely delivery.
